Este artículo intenta poner de manifiesto el papel que jugó el “mar” en el desarrollo de un derecho moderno con pretensiones cada vez más universales.

Nunca es mal momento para repensar, y llegado el caso actualizar, ese conjunto de conceptos y ese racimo de valores que de manera inopinada conforman la realidad que tercamente se nos impone y a la que, con más o menos fortuna, tratamos incesantemente de dar sentido. Y, sin embargo, la reivindicación intempestiva de pasar por el cedazo de la crítica un término tan de justicia entre nosotros como el de meritocracia es presumible que genere, antes incluso de ser leído, un (...) inicial recelo, secundado por un más que probable desconcierto. Tan interiorizadas como están las reglas del juego neoliberal —digámoslo de una vez: nos vencieron y nos convencieron—, a nadie puede sorprender, ya que constituya una verdadera provocación el suspender, si quiera por un momento, un valor tan consagrado entre nosotros como el de la meritocracia... The debate over judicial review of legislation is profuse. But differences are often due to the lack of a common methodology. This article discusses the proper way to evaluate judicial review and confronts central challenges raised against it. It develops the two main models that can be used for analyzing the intersection between democracy and constitutional decision-making and shows that judicial oversight may not be rejected, regardless of how we interpret that connection. The article discusses in detail the model developed (...) by Jeremy Waldron. A nice attempt to answer methodological questions, Waldron's model wrongly tips the balance against judicial review. Its excessive level of abstraction and idealization renders it inoperable. Few systems meet its standards, and those that do pay a high price: they contradict the concept of democratic legitimacy that underlies the model. Paradoxically, a system with judicial review may end up being more legitimate than one without it. (shrink)

Category-based induction is an inferential mechanism that uses knowledge of conceptual relations in order to estimate how likely is for a property to be projected from one category to another. During the last decades, psychologists have identified several features of this mechanism, and they have proposed different formal models of it. In this article; we propose a new mathematical model for category-based induction based on distances on conceptual spaces. We show how this model can predict most of the properties of (...) this kind of reasoning while providing a solid theoretical foundation for it. A propósito de la Parábola del Buen Samaritano, ¿este habría sido reemplazado por el espectador distante o implicado? ¿Qué sucede cuando ese espectador, de tanto ver (...) naufragios, termina fatigado? ¿Y de tanta fatiga, se vuelve indiferente? ¿Qué significa ser espectadores de naufragios en una época en la que la catástrofe no es ocasionada exclusivamente por fuerzas naturales sino por los propios seres humanos? ¿Es posible hallar hoy alguna orilla segura para reconocernos distanciados y salvados de las catástrofes ajenas? In this paper, we outline a comprehensive approach to composed analogies based on the theory of conceptual spaces. Our algorithmic model understands analogy as a search procedure and builds upon the idea that analogical similarity depends on a conceptual phenomena called ‘dimensional salience.’ We distinguish between category-based, property-based, event-based, and part-whole analogies, and propose computationally-oriented methods for explicating them in terms of conceptual spaces.

En un interesante y polémico texto publicado por Alejandro Pinzani y Nuria Sánchez Madrid en 2016, bajo el título “The State Looks Down: Some Reassessments of Kant’s Appraisal of Citizenship”, los autores plantean una pregunta a la que aludo en el título del presente trabajo: Kant ¿liberal? ¿republicano? ¿o ambas cosas?, decantándose finalmente por un “ambas cosas”. Procuro discutir ciertas consideraciones sobre la distinción entre ciudadanía pasiva y activa; y la tesis que afirma que: por su clara aversión ante la (...) intervención del Estado en materia económica –incluso en casos de privación material- Kant podría ser enrolado en una posición liberal clásica en la que el Estado no debe intervenir en el status quo económico, pues se trata de transacciones privadas entre individuos libres. Dada la especie de clausura al que las historias de las ideas en Colombia han llevado al expediente sobre las relaciones entre positivismos y tradicionalismos, y ante la necesidad de construir unos criterios de reconocimiento del "positivismo", creo necesario hacer un trabajo preliminar de reproblematización de esas relaciones en el nivel global, utilizando los aportes de historiadores y filósofos europeos y colombianos, a lo que dedicaré las páginas siguientes. Lo que sorprende en la literatura más reciente sobre las relaciones entre (...) tradicionalismos y positivismos es el señalamiento de una serie de singulares parentescos, contra lo que hemos pensado habitualmente. In Gärdenfors and Makinson :197–245, 1994) and Gärdenfors it was shown that it is possible to model nonmonotonic inference using a classical consequence relation plus an expectation-based ordering of formulas. In this article, we argue that this framework can be significantly enriched by adopting a conceptual spaces-based analysis of the role of expectations in reasoning. In particular, we show that this can solve various epistemological issues that surround nonmonotonic and default logics. We propose some formal criteria for constructing and updating (...) expectation orderings based on conceptual spaces, and we explain how to apply them to nonmonotonic reasoning about objects and properties. El objetivo del trabajo es mostrar que la pobreza es, para Kant, la contracara de una distribución social de la propiedad adquirida incompatible con la igual libertad de todos según leyes universales. El problema de la pobreza no es –dejó dicho Kant– un tema de beneficencia o de deberes éticos laxos de cada cual. Tampoco es un asunto de un derecho de necesidad que habilitara al pobre a robar cuando sus necesidades elementales no están satisfechas. Es un problema estructural en (...) la constitución de un estado jurídico, una grieta fatal en el diseño de sus Instituciones públicas incapaces de configurar una vida social acorde con la reciprocidad en la libertad externa de todos. Populism is widely thought to be in tension with liberal democracy. This article clarifies what exactly is problematic about populism from a liberal–democratic point of view and goes on to develop normative standards that allow us to distinguish between more and less legitimate forms of populism. The point of this exercise is not to dismiss populism in toto; the article strives for a more subtle result, namely, to show that liberal democracy can accommodate populism provided that the latter conforms to (...) particular discursive norms. What the article calls a ‘liberal ethics of populism’ turns out to be closely bound up with a broader ethics of peoplehood, understood as a way of articulating who ‘the people’ are in a way that is compatible with liberal–democratic principles of political justification. Such an ethics, concludes the article, inevitably has a much wider audience than populist political actors: its addressees are all those who seek legitimately to exercise power in the name of the people. A través del presente ejercicio investigativo y hermenéutico se busca proponer la beneficencia como principio articulador entre la Teología Moral de la Persona, la Bioética y las Prácticas Biomédicas, con el fin de salvaguardar al ser humano de forma integral y desde el ámbito interdisciplinar, frente a la manipulación y menoscabo de la persona en su: dignidad, status antropológico, verdad ontológica y trascendente, lo cual nos lleva a proponer alternativas, dadas las nuevas circunstancias por las que atraviesa la humanidad; y (...) es aquí donde adquiere resonancia proponer la Beneficencia como principio articulador entre estas tres ciencias, dado que ella, como principio, está en los tres saberes de forma implícita y explícita y, las cuales, por su misma esencia, tienen puntos de convergencia como son: la determinación de su carácter moral, su estatuto de servicio, la salvaguarda de la riqueza de la vida, el reconocimiento y respeto por la dignidad humana, el reconocimiento de la multidimensionalidad del ser, y el cuidado que requiere toda persona humana en su fragilidad y vulnerabilidad. Además de lo anterior se cuenta con un abordaje teórico sobre la bioética como saber interdisciplinar; los principios de la bioética y la relación de la teología moral de la persona con la bioética. A partir de un ejercicio interpretativo en el campo de la sociología y antropología urbanas, se muestra que éste es el resultado de las contingencias y dinámicas ciudadanas propias que trascienden cualquier especulación teórica, pero que genera un modo de ser particular de los ciudadanos por (...) su comprensión y apropiación, en este caso, de los habitantes de Medellín. Focused on city-scale automation, and using self-driving cars (SDCs) as a case study, this article reflects on the role of AI—and in particular, computer vision systems used for mapping and navigation—as a catalyst for urban transformation. Urban research commonly presents AI and cities as having a one-way cause-and-effect relationship, giving undue weight to AI’s impact on cities and overlooking the role of cities in shaping AI. Working at the intersection of data science and social research, this paper aims to counter (...) this trend by exploring the reverse perspective: how do cities affect the development, and expose the present limits, of SDCs? The contribution of this paper is threefold. First, by comparing urban and nonurban environments and thoroughly examining the relationship between computer vision and city-specific sociality and form, it defines machine autonomy/automation as a function of the sociotechnical milieu in which an AI system operates. Second, and related, the paper problematizes the notion of SDCs as autonomous technologies and the role it plays in envisioning contending policy arrangements and technical solutions for achieving full driving automation. Finally, the article offers insight into a materialist and spatialized understanding of AI—namely, not as an abstract quality susceptible to replication within discrete machines, but rather as a distributed property emerging through embodied interactions among a multiplicity of agents (human, non-human, and technological) within/with their environments. In a recent paper, Pruss proves the validity of the rule beta-2 relative to Lewis’s semantics for counterfactuals, which is a significant step forward in the debate about the consequence argument. Yet, we believe there remain intuitive counter-examples to beta-2 formulated with the actuality operator and rigidified descriptions. We offer a novel and two-dimensional formulation of the Lewisian semantics for counterfactuals and prove the validity of a new transfer rule according to which a new version of the consequence argument can (...) be formulated. This new transfer rule is immune to the counter-examples involving the actuality operator and rigidified descriptions. However, we show that counter-examples to this new rule can also be generated, demanding that the Lewisian semantics be generalized for higher dimensions where counter-examples can always be generated. Popular sovereignty requires that citizens perceive themselves as being able to act and implement decisions, and that they are de facto causally connected to mechanisms of decision making. I argue that the two most common understandings of the exercise of popular sovereignty—which center on direct decision making by the people as a whole and the indirect exercise of democratic agency by elected representatives, respectively—are inadequate in this respect, and go on to suggest a complementary account that stresses the central role (...) of internally democratic and participatory political parties in actualising popular sovereignty, drawing on the democratic theory of Hans Kelsen. These movements are readily criticized by journalists or political rivals, yet none of the common objections to populism seems to arrest their success. This article turns to normative political theory to cultivate sensitivity to problems arising from some existing arguments against populism, and to explore possible alternatives. It offers a critical reading of prototypical liberal and conservative arguments against populism, and proposes that the principles of solidarity and procedure provide good grounds (...) for a sustainable critique of populism. Summary The paper follows the lives of Mateu Orfila and François Magendie in early nineteenth-century Paris, focusing on their common interest in poisons. The first part deals with the striking similarities of their early careers: their medical training, their popular private lectures, and their first publications. The next section explores their experimental work on poisons by analyzing their views on physical and vital forces in living organisms and their ideas about the significance of animal experiments in medicine. The last part (...) describes their contrasting research on the absorption of poisons and the divergences in their approaches, methods, aims, standards of proof, and intended audiences. The analysis highlights the connections between nineteenth-century courtrooms and experimental laboratories, and shows how forensic practice not only prompted animal experimentation but also provided a substantial body of information and new research methods for dealing with major theoretical issues like the absorption of poisons. In a recent article, P. Roger Turner and Justin Capes argue that no one is, or ever was, even partly morally responsible for certain world-indexed truths. Here we present our reasons for thinking that their argument is unsound: It depends on the premise that possible worlds are maximally consistent states of affairs, which is, under plausible assumptions concerning states of affairs, demonstrably false. Our argument to show this is based on Bertrand Russell’s original ‘paradox of propositions’. We should then opt (...) for a different approach to explain world-indexed truths whose upshot is that we may be morally responsible for some of them. The result to the effect that there are no maximally consistent states of affairs is independently interesting though, since this notion motivates an account of the nature of possible worlds in the metaphysics of modality. We also register in this article, independently of our response to Turner and Capes, and in the spirit of Russell’s aforementioned paradox and many other versions thereof, a proof of the claim that there is no set of all true propositions one can render false. Purpose This study aims to explore whether face recognition technology – as it is intensely used by state and local police departments and law enforcement agencies – is racism free or, on the contrary, is affected by racial biases and/or racist prejudices, thus reinforcing overall racial discrimination. Design/methodology/approach The study investigates the causal pathways through which face recognition technology may reinforce the racial disproportion in enforcement; it also inquires whether it further discriminates black people by making them experience more racial (...) discrimination and self-identify more decisively as black – two conditions that are shown to be harmful in various respects. Findings This study shows that face recognition technology, as it is produced, implemented and used in Western societies, reinforces existing racial disparities in stop, investigation, arrest and incarceration rates because of racist prejudices and even contributes to strengthen the unhealthy effects of racism on historically disadvantaged racial groups, like black people. Practical implications The findings hope to make law enforcement agencies and software companies aware that they must take adequate action against the racially discriminative effects of the use of face recognition technology. Social implications This study highlights that no implementation of an allegedly racism-free biometric technology is safe from the risk of racially discriminating, simply because each implementation leans against our society, which is affected by racism in many persisting ways. Originality/value While the ethical survey of biometric technologies is traditionally framed in the discourse of universal rights, this study explores an issue that has not been deeply scrutinized so far, that is, how face recognition technology differently affects distinct racial groups and how it contributes to racial discrimination. It is a widely held principle that no one is able to do something that would require the past to have been different from how it actually is. This principle of the fixity of the past has been presented in numerous ways, playing a crucial role in arguments for logical and theological fatalism, and for the incompatibility of causal determinism and the ability to do otherwise. I will argue that, assuming bivalence, this principle is in conflict with standard views about (...) knowledge and the semantics for ‘actually’. Con ocasión del 80 aniversario de la Universidad Iberoamericana y de su Departamento de Filosofía hemos querido recuperar y comentar uno de los dos primeros libros que se publicaron en lo que entonces se llamaba Centro Cultural Universitario. El libro que nos ocupa es fiel testimonio de la época en que fue publicado. Las conferencias del padre jesuita Ledit son ejemplo de la manera de entender la historia moderna y contemporánea de muchos pensadores católicos preconciliares. La cristiandad medieval había realizado (...) una síntesis con el pensamiento griego. La modernidad fue la paulatina separación de esta filosofía perenne abierta a la trascendencia, con el resultado de una razón soberbia y orgullosa de su finitud; una de sus consecuencias fueron los sistemas totalitarios de la primera mitad del siglo xx, los cuales en su confrontación llevaron al estallido de la Segunda Guerra Mundial. Cinco generaciones de utilitaristas, apoyados en la ciencia social posterior a la revolución marginalista neoclásica, destruyeron la conexión clásica entre la reflexión filosófica normativa y el mundo de los derechos y de las instituciones sociales. El estilo de hacer filosofía política inaugurado por Rawls no sólo prometía romper a su vez con todo eso, sino que, aparentemente, apuntaba a una consciente reanudación de la manera clásica -preutilitarista, preneoclásica- de hacer filosofía política: derechos, virtudes, contratos, clases sociales y entramados institucionales -no (...) sólo utilidades maximizadas por individuos atomísticamente y a -institucionalmente concebidos- volvían al núcleo de una filosofía política que se presentaba como «neocontractualista». En este artículo se argumenta que algunas de las opciones metodológicas asociadas al legado de Rawls explican el que la promesa fuera sólo muy parcialmente cumplida. A partir de la crisis del «rawlsismo metodológico» que se ha hecho patente en los últimos años, los autores, republicanos avant la mode, tratan de explicar el espectacular auge experimentado recientemente -a favor y en contra- por la vieja tradición republicana. Large exchange markets, big money, interest-bearing credit, big landholdings, proletarian masses, imperial expansion and even ‘capital’ or ‘salaried workers’, are not in themselves specific, unique institutional features of Modern Capitalism. This article argues that the features that characterize Modern Capitalism are a massive emergence of ‘free’, monetized wage labour, a self-propelled rush to unbounded world expansion and the progressive conversion of expropriated and privatized land into a monetized commodity, as well as a radically new use of the ancestral social institutions (...) of money and credit as an instrument for financing the production of commodities to obtain a surplus in the form of monetary profit, but also to generate expropriatory social debt relations. This article explains these dynamic historical forces and their importance for political philosophy and for legal and economic history and economics and sheds some light on the relationship between ‘capitalism’ and ‘modernity’. Resumen En este artículo se reflexiona sobre la relación entre literatura y enfermedad, concentrando la atención en la perspectiva de Kierkegaard y de Kafka. Después de analizar la postura kierkegaardiana se pasa a la kafkiana y, finalmente, se comparan los resultados obtenidos. De este modo, se pueden apreciar las diferencias entre los dos planteamientos y, sucesivamente, utilizar los elementos en común para esbozar unas características interesantes sobre la relación entre literatura y enfermedad en los siglos XIX y XX en el (...) contexto de influencia alemana. Esto nos lleva a reflexionar sobre las conexiones causales entre la enfermedad y la literatura, y sobre el contexto social o íntimo en el cual estas se desarrollan.I analyze the topic of sickness in relation to 19th and 20th Century Literature in the Germanophile area. In particular, I examine Kierkegaard's and Kafka's perspectives. In the case of Kierkegaard, he principally wrote about sickness in his diaries, and in two important books: The Concept of Anxiety and The Sickness unto Death. However, Kafka wrote about the same theme in all his diaries. Therefore, in this study, I will compare the different perspectives of these two authors in relation to both sickness and literature. Through this, I will attempt to extract any key aspects that can be used for identifying a more general relation between sickness and literature in the 19th and 20th Centuries. To achieve this aim, I will firstly scrutinize Kierkegaard's posture, and then Kafka's posture. Following this, I will compare the findings to draw general conclusions. (shrink)

En el presente trabajo se muestra cómo la filosofía política práctica se materializa en técnicas gubernamentales que han generado una institucionalidad que busca tener un impacto de pacificación, tolerancia, democratización y búsqueda de la equidad en la sociedad colombiana. La investigación se centra en el influjo del modelo democrático deliberativo en Colombia y su contribución a la configuración de la Constitución Política de 1991. La metodología empleada implica, en primer lugar, la conceptualización de la democracia deliberativa. A continuación, se analiza (...) la recepción de este modelo en Colombia, destacando las ideas que influyeron en la redacción constitucional. Finalmente, se exploran los impactos concretos de la democracia deliberativa en la mencionada Constitución, revelando cómo esta filosofía política práctica ha dejado su huella en la estructura normativa del país. En un pasaje a la vez críptico y fascinante de la Metaphysik der Sitten, Kant generó un cambio metodológico definitivo para justificar la adquisición de «lo mío y lo tuyo exterior», mediante la hipótesis racional y no empíricamente comprobable de la apropiación originaria común del suelo: «Todos los hombres están originariamente en posesión legítima del suelo, es decir, tienen derecho a existir ahí donde los han situado la naturaleza o el azar». Es así como el apasionado defensor del carácter adquirido (...) -no innato- del derecho de propiedad deja espacio para un único derecho natural emanado del ejercicio de la libertad : el derecho de todo el género humano a tomar posesión de un lugar en la superficie esférica y no infinita de la tierra. Una interpretación histórica-política de estos pasajes permitiría evaluar las consecuencias revolucionarias de un cambio metodológico aparentemente «menor». (shrink)
